How to Apply for a Work Permit?

First Stage: Creating the Employer Registration

In the e-permit system, 3 types of employer registration are made.

  1. Home Services Employer - (With the Employer's TR Identity Number)

  2. Foreigner Working on His Own Name and Account - (Foreigner's Foreigner ID Number starting with 99)

  3. New Workplace (All companies) - (With the 26-digit SGK registration number of the workplace and by the SGK e-declaration user)

Employer Management Panel:

Home Services and Craftsmen - Home Services employers and foreigners who will work on their own name and account themselves.

Companies - E-declaration officials who open the registration in company employers.

Becoming admin - "Admin" becomes user. These people can enter the employer management panel.

Admin User:

  • You can see and update workplace information,

  • You can see the list of applications made on behalf of the workplace,

  • Authorize third parties to apply on behalf of the workplace by entering their TR ID numbers, cancel the authorizations granted,

  • It can change the authorities of the applications made on behalf of the workplace.

Second Stage: Work Permit Application

After the employer completes the first stage of the work permit application, the work permit application can be started for the foreigner who will be employed through this employer.

After connecting to the e-permission application, there are e-state and electronic signature (Webstart) options that users will use when logging into the page.

Application Types

  • Domestic First Application - It is made for foreigners who are in our country and hold a valid residence permit for at least six (6) months. In this case, the foreigner has a TR Foreigner Identity Number starting with 99.

  • First Application Abroad - If the foreigner does not have a residence permit, he / she applies for a work visa by going to the Turkish foreign representative office in the country of nationality. It has a 16-digit reference number that will be given to it from there.

  • International Protection Application - It is made for foreigners who are under international protection in our country and who have an international protection application. The foreigner has an international protection residence permit.

  • Temporary Protection Application - It is made for foreigners of Syrian nationality under temporary protection in our country. The foreigner has a temporary protection residence permit.

  • Application for Extension - It is made to extend the ongoing work permit obtained from our Ministry. It must be done within 2 (two) months before the end of the previous permit.

Required Information and Documents

Work permit applications generally work permits for foreign missions of the Republic of Turkey regarding foreign and begin to form to apply for a visa.

But foreigners continued validity of at least 6 months term residence permit, work permit applications can be made in Turkey if the domestic applicants.

Required documents will be sent online through the e-permit automation system.

  • Employment contract signed by the employer and the foreigner. (This document will be scanned and sent online during electronic application.)

  • Passport copy. (In cases where the passport is not written in Latin letters, a sworn translator or officially approved translation will be attached to the application.) (This document will be scanned and sent online during the electronic application.) Important Note: Pursuant to Article 23 of Law No. The work permits to be granted are arranged in a way not to exceed the date sixty days before the expiry date of the passport. In addition, work permit applications made with a passport and a passport substitute document for less than sixty days as of the work permit application date are not processed.

  • Copy of Diploma or Temporary Graduation Certificate with Turkish translation approved by a sworn translator or official authorities. (This document will be scanned and sent online during electronic application.) A diploma is mandatory for foreigners who will work within the scope of professional services and foreigners who will work in professions deemed necessary by our Ministry. It is not compulsory to submit a diploma in household services, a declaration regarding the last school completed is sufficient.

  • Turkey showing the last capital and partnership structure Organization Trade Registry Gazette.

  • Balance sheet and profit / loss statement for the last year approved by the tax office or certified public accountant.

  • COVID-19 Declaration; The sample text submitted by the e-permit system must be prepared on the letterhead, including the company stamp and the full name, surname and signature of the official.

While requesting only the COVID-19 Covenant for domestic applications, a health certificate indicating that the COVID-19 test made in the foreigner's country is negative should also be attached.

Education Sector:

  • For foreigners who will work in private education institutions affiliated to the Ministry of Education, a document showing the professional competence of the foreigner from the Ministry of National Education (Preliminary Permit Document)

  • For private education institutions that will employ foreigners, "Permission to Open Institutions and Start Education" and "License" obtained from the Ministry of National Education

Home Services:

  • Foreigners are not allowed to work in household services except for elderly, sick and child care.

Health sector:

  • For foreign healthcare professionals who will work in private health institutions affiliated to the Ministry of Health, the Preliminary Permit Certificate obtained from the Provincial Health Directorate of the province where the health institution is located. (This document will be scanned and sent online during electronic application.)

  • For private health institutions that will employ foreigners, Activity Permit Certificate obtained from the Provincial Health Directorate.

Tourism sector:

  • Business and Investment Certificate obtained from the Ministry of Culture and Tourism for foreigners to be employed in workplaces with a tourism management certificate, and an Activity Certificate from the Chamber of Commerce if it is not a certified business. (This document will be scanned and sent online during electronic application.)

Entertainment Industry:

  • Testimonial with a Turkish translation approved by a sworn translator or official authorities (The testimonial showing that the foreigner, whose work permit is requested, has an international reputation as an artist or has worked in foreign enterprises at the same level, will have an apostille annotation according to the 1961 Hague Convention or an annotation of Foreign Representation.) (This document is electronic application. will be scanned and sent online.)

  • Employment Contract drawn up in Turkish and foreign language (Employer and foreigner with wet signatures will be scanned and sent online during electronic application.)

  • Business Certificate from the Ministry of Culture and Tourism,

Required Issues to be Included in the Employment Agreement with Foreign Artists:

  • Registration stating that the foreign artists will undertake that their return tickets and travel expenses will be covered by the employer upon their return to their countries after their working period,

  • The commitment that the wage cannot be less than three times the minimum wage that changes every six months,

  • Workplace tax number,

  • In addition to the employee's rights, there will be 155 Police Helpline and 157 Helpline for Victims of Human Trafficking, Alo 170 helpline numbers and contact phones of Provincial Directorates of Labor and Employment Agency of our Ministry to be consulted when necessary.

Aviation Sector:

  • In establishments operating in the aviation sector will be employed foreign pilots for its Turkish translation sworn translator or officially approved Pilot License (This document will be sent taranılarak online during electronic application.) will be held by our ministry work permits, licenses of foreign pilots validates the Ministry of Transport Civil Aviation in Turkey It becomes valid with the Validation Certificate to be obtained from the General Directorate.

Engineers and Architects:

  • "Diploma or Provisional Graduation Equivalency Certificate" to be received by the foreigner, who is requested to work as an engineer / architect within the scope of Professional Services, in accordance with the Regulation on Equivalence of Higher Education Diplomas Abroad, in accordance with Articles 3 and 7 / p of the Law numbered 2547 (This document will be scanned and sent online during the electronic application.)

  • In the legal entities that will employ foreign experts as engineers / architects / urban planners, the payroll showing that the Turkish is employed in the same profession (This document will be scanned and sent online during the electronic application.)

Companies and Branches Operating in the Scope of Direct Foreign Investments Offering Features:

  • Foreigners to be employed in companies and branches that meet at least one of the criteria for foreign direct investments, which are specified in Article 10 / a of the Regulation on Foreign Personnel Employment in Foreign Direct Investments, will be applied according to the following procedures and principles.

  • Documents stating that the last year's export amount made by the organization is at least 1 million USD (documents such as bank receipt, bank letter, copy of foreign exchange purchase document, company approved income statement)

Documents Required for Key Personnel to Work in the Organization that Satisfies At Least One of the Conditions stated above:

  • Company Partner, Chairman of the Board, Board Member, General Manager, Deputy General Manager, Company Manager, Company Deputy Manager, etc. for positions (Signature Circular, Board of Directors or a copy of the Board of Shareholders Decision)

  • Services, research equipment, techniques or experts with basic knowledge for management (testimonial and translation, diploma copy and translation, value documents and information and translation for the area where the personnel in this scope will be employed (For example, for export personnel, by the relevant bank showing the export on country basis) such as certified bank receipt, bank letter, copy of foreign currency purchase document)

  • An assignment letter stating that the key personnel to be employed are assigned by the parent company abroad

Liaison Offices:

  • For foreigners to be employed in liaison offices, the activity permit obtained from the Ministry of Economy, this document will be scanned during electronic application and sent online.

  • For liaison offices, documents showing that at least USD 200 thousand or equivalent foreign currency has been brought from abroad in the last year (For the office officer, documents such as authorization certificate and bank receipt related to foreign currency transfer, bank letter, copy of foreign currency purchase document)

Lower Limits for Work Permit Application

The Criteria Establishing the Minimum Requirement for Applicant Workplaces and Foreigners to be Evaluated for the Work Permit Requests of Foreigners are stated below.

IMPORTANT NOTE: The following requirements are the lower limits for the work permit application and do not mean the requirements for granting a work permit. Even if the following criteria are met, this does not mean that the work permit application will result in a positive result.

WORKPLACE;

  • At least five Turkish citizens must be employed in the workplace for which a work permit is requested. In the event that a work permit is requested for more than one foreigner in the same workplace, the employment of five Turkish citizens will be sought for each foreigner after the first foreigner who has been given a work permit.

  • If the foreigner requesting permission is a company partner, the employment condition of five people is sought for the last six months of a one-year work permit to be granted by the Ministry.

  • The paid-in capital of the workplace must be at least 100,000 TL or the gross sales must be at least 800,000 TL or the last year's export amount must be at least 250,000 USD.

  • Associations and foundations permit requests concerning foreigners to work in Article 2 of the foreign state airline of Turkey's representative, will work in the education sector and home services in the evaluation of applications for work permits of foreigners, Paragraphs 1 and 2 of Article shall not apply.

  • It is obligatory that the foreign shareholder of the company requesting permission has a capital share of at least 20 percent, not less than 40,000 TL.

FEES:

The monthly wage declared to be paid to the foreigner by the employer must be at a level compatible with the foreigner's duty and competence.

Accordingly, taking into account the minimum wage in effect as of the date of application, the minimum wage to be paid to the foreigner;

  • 6.5 times the minimum wage for senior executives, pilots and engineers and architects requesting pre-permit,

  • 4 times the minimum wage for unit or branch managers, engineers and architects,

  • 3 times the minimum wage for foreigners who will work in jobs that require expertise and mastery, as well as teachers, psychologists, physiotherapists, musicians and performers,

  • Minimum minimum wage for foreigners to be employed in domestic services,

  • For foreigners who will work in other professions (such as sales staff, marketing-export staff) other than those listed above, the minimum wage should be 1.5 times.

  • 2 times the minimum wage for foreigners who will work in tourism-animation organization companies as acrobats and similar titles, and for foreigners who will work in jobs such as masseurs, masseuses and SPA therapists.

  • Requests of masseur, masseuse and SPA therapist that require expertise and skill from at least four-star tourism businesses and certified holiday villages certified by the Ministry of Culture and Tourism, which prove that they have a massage parlor, will be evaluated, and the demands of businesses and workplaces that are not included in this scope will not be approved.

  • (Amended: 20.4.2011 / ÇGM-8108) In the event that at least 10 Turkish citizens are employed for foreigners to be employed in the entertainment sector and tourism-animation organization companies requiring expertise and mastery, the quota for the employment of five Turkish citizens separately for each foreigner will not be applied.

  • (Additional matter: 20.04.2011 / CGM-8108) in Turkey is a party that bilateral or multilateral agreements with provisions in cases with public institutions and organizations contract or tendering procedures with goods and service purchases will be executed 1st in the evaluation of requests for work permits for foreigners The criteria specified in articles and 2 will not be applied.

  • (Supplementary article: 20.4.2011 / ÇGM-8108) In cases requiring advanced technology or in the absence of a Turkish expert with the same qualifications, the criteria determined by the 1st and 2nd articles will not be applied upon the approval of the General Directorate.

  • (Supplementary article: 20.4.2011 / ÇGM-8108) For foreigners to be employed other than key personnel in enterprises that meet the conditions of Special Foreign Direct Investment, the criterion determined in article 1 is applied based on the number of Turkish citizens working in all workplaces of the enterprise.
